Crucially, we recognise the client's need for financial clarity, we offer clear advice on budget at the outset, ensuring you are fully informed and confident to make strategic decisions that safeguard your legal and financial interests throughout the entire process.

Power of Attorneys

A Power of Attorney (POA) is the most proactive step you can take to ensure you’ll be properly looked after in the event you can no longer look after yourself. By doing a POA you grant a trusted individual the ability to manage your finances and personal welfare on your behalf.

The key benefit of having a POA in place before you need it, is that you are able to choose who will look after you and how you’ll be looked after. Without a POA, it could take expensive and stressful sheriff court actions for someone to be able to make decisions on your behalf. Whereas by having a POA in place, you ensure key decisions are made exactly according to your wishes.

Our expert solicitors specialise in drafting the right POA for your specific needs and providing the professional guidance required to select a reliable Attorney. By using Waddell & Mackintosh, you gain the confidence that this important legal document is executed properly and in full compliance with the ‘Adults With Incapacity (Scotland) Act 2000’, securing your interests for when you need it most.

Executries

Dealing with the estate of a deceased loved one is a difficult and emotional experience. This is often complicated by shareholder services and banks and courts being difficult to deal with. Being an Executor and winding up an estate also comes with significant legal liabilities and as such requires specialist advice and support.

In order to avoid personal liability for any debts or claims made against the estate, Executors must ensure the estate is not distributed within the six-month statutory period. Furthermore, all Inheritance Tax must be settled before Confirmation can be granted, which is the necessary legal authority from the Sheriff Court.

Our highly experienced team of solicitors provide the expert advice and support you need to navigate every aspect of these complex procedures. We ensure the estate is administered efficiently and in full compliance with the law, guiding you through this difficult time with professionalism and understanding.

Wills

A Will is the single most cost-effective way to protect your interests and provide peace of mind for your loved ones. Without one, your estate faces frustrating delays, increased legal and court costs, and is distributed strictly by the law; ‘Succession (Scotland) Act 1964’. This means that the law decides who inherits, rather than you.

By instructing Waddell & Mackintosh to write your Will, you regain control. You appoint your desired executors, specify exactly who inherits your assets and streamline the entire executry process. Our experienced solicitors are passionate about ensuring every client secures this essential protection and can write any Will to suit your needs whatever they may be.

Notarial Services

Each solicitor in Waddell & Mackintosh is also a Notary Public.

If you require a document Notarised we can do that at a meeting with you. If the Notarisation work is for one or two standard documents, Waddell & Mackintosh normally do not charge a fee. Waddell & Mackintosh would however ask you to make a donation to The Ayrshire Hospice, a charity that our legal firm considers to be a worthy cause for all the help they give to the residents of Ayrshire. Waddell & Mackintosh have collection pots in both our offices and we request you make your donations in cash.

Please contact the office to discuss your Notarising needs.
